Acceptable Use Policy

This Acceptable Use Policy ("Policy") governs your conduct when using the Gearmind mobile application, the website at gearmind.in, and all related features, including the digital garage, AI tools, and community features (the "Service"), operated by Gearmind ("Gearmind", "we", "us", or "our").
This Policy is part of, and incorporated by reference into, our Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service. Violating this Policy is a violation of the Terms of Service and may result in suspension or termination of your account.
You agree not to engage in, attempt, or assist any of the following.
1. No Scraping or Reverse Engineering
You may not:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, structure, training data, weights, prompts, or underlying logic of any Gearmind software or AI matching, recommendation, or diagnostic models.
- Scrape, crawl, harvest, index, cache, copy, or systematically extract our fitment data, parts catalog, parts architecture, compatibility datasets, or any other content from the Service, whether by automated means (bots, spiders, scripts) or manual means, except as expressly permitted by us in writing.
- Use the AI tools, outputs, or fitment data to build, train, fine-tune, or improve any competing product, model, or dataset, or to create a derivative database or service.
- Circumvent, disable, or interfere with any rate limits, access controls, authentication, encryption, watermarking, or other technical protection measures.
- Access the Service through any interface or method other than those we provide (for example, undocumented or private APIs) without our written permission.
2. Safety and Legality
The Service must not be used to facilitate, promote, document, or carry out illegal, unsafe, or fraudulent vehicle-related activity. You may not use the Service to:
- Plan, request, share, or promote modifications that are illegal to use on public roads, including but not limited to emissions-control defeat or bypass devices, removal or tampering with catalytic converters, illegal exhaust or noise modifications, or odometer/ECU tampering intended to deceive.
- Catalog, list, advertise, sell, source, or seek stolen, counterfeit, or illegally obtained parts or vehicles, or assist in concealing the origin of such items.
- Solicit, share, or promote unsafe structural modifications — such as compromised frame, brake, steering, suspension, fuel-system, or load-bearing alterations — that a reasonable person would understand to create a risk of serious injury or death.
- Provide instructions or encouragement for evading vehicle registration, inspection, insurance, taxation, or safety-certification requirements.
- Facilitate any other activity that violates applicable laws, regulations, manufacturer safety requirements, or the rights of any third party.
3. System Abuse and Security
You may not abuse, overload, disrupt, or compromise the Service or its infrastructure. Specifically, you may not:
- Spam, flood, or abuse the AI APIs or any endpoint, including sending automated, excessive, or high-volume requests, or otherwise consuming resources in a manner that degrades the Service for others or circumvents usage limits.
- Probe, scan, or test the vulnerability of any Gearmind system or network, or breach or circumvent any security or authentication measures, without our prior written authorization.
- Upload, transmit, or distribute any malicious code, including viruses, worms, trojans, ransomware, or any code designed to disrupt, damage, disable, or gain unauthorized access to any system, data, or account.
- Attempt to gain unauthorized access to any account, server, or data, or impersonate any person, account, or entity, or misrepresent your affiliation with anyone.
- Interfere with or disrupt the integrity or performance of the Service, including through denial-of-service attacks, injection attacks, or manipulation of headers or identifiers.
4. Community and Content Conduct
When using community and content-sharing features, you may not post, upload, or share content that:
- Is unlawful, defamatory, harassing, threatening, hateful, or invasive of another's privacy.
- Infringes any intellectual property, privacy, or other right of any person or entity.
- Is sexually explicit, exploits minors, or promotes violence or self-harm.
- Is spam, deceptive, fraudulent, or a phishing attempt, or contains unsolicited advertising.
- Contains knowingly false or dangerous build specifications, fitment claims, or safety information presented as verified fact.
5. Misuse of AI Tools
You may not use the AI tools to:
- Generate content that violates this Policy or any law.
- Deliberately attempt to manipulate, jailbreak, or coerce the AI into producing prohibited, unsafe, or restricted outputs.
- Misrepresent AI-generated output as certified professional, engineering, or safety advice to others.
6. Reporting Violations
If you become aware of any violation of this Policy, or of content or conduct that threatens safety or security, please report it to us at support@gearmind.in.
7. Enforcement
We may investigate suspected violations and take any action we deem appropriate, including removing content, issuing warnings, throttling or restricting access, suspending or terminating accounts, and cooperating with law enforcement. We may take these actions with or without notice and at our sole discretion. We are not liable for any action taken in good faith to enforce this Policy.
8. Changes to This Policy
We may update this Policy from time to time. Changes take effect when we post the updated Policy and revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Policy.
